HOW THE NLRB HAS CHANGED THE RULES REGARDING SEVERANCE AGREEMENTS ABC Nebraska South Dakota Chapter Counsel, Jerry Pigsley, will share information on a recent ground breaking National Labor Relations Board (Board) decision holding both non-disparagement and confidentiality clauses in severance agreements are unlawful. The pro-union Board has found these boilerplate provisions have a reasonable tendency to interfere with, restrain, or coerce the exercise of employee rights under Section 7 of the National Labor Relations Act. Jerry will discuss common questions that have arisen among merit shop contractors as to how the Board decision impacts employee handbooks, settlement agreements, and non-competition agreements or other restrictive covenants.
